In the middle of the first case, two men were summoned as perpetrators and victims of violence that occurred in Arudy in March 2021, along the greenway. That day, one of the two accused was jogging when he saw a Malinois dog come out of a house and approach him. “When attacked by an animal of the same kind, I take precautions: I ask him to lie down twice”. Then the dog’s owner appears and a fight begins between the two men, though they don’t give the same version.
For the owner of the animal, it is the jogger who, after kicking his dog, will deliver him the first blow, prompting him to retaliate and hit him twice. . “Even now, my dog is traumatized by this altercation.” The scuffle cost the man a day of total incapacity for work for a bruised jaw.
For his part, the runner claims not to have struck a blow: “I just asked the owner of the dog to calm down. He hit me and I fell to the ground, then he shook me, put his arms around me”. The jogger escaped with a fracture that required surgery, resulting in total incapacity for work for fifteen days.
“We are almost in a playground altercation”, retorts the public prosecutor Rodolphe Jarry. “We are faced with two irreconcilable positions. One thing is certain: both men used violence. So I intend to send them back”. The vice-president of the court of Oloron Catherine Sargenti will follow the requests of the prosecutor by condemning the two defendants to a fine of 1,000 euros accompanied by a reprieve of 500 euros.
A battered septuagenarian
The following case is also related to the violence that occurred in Arudy. The facts occurred in two stages: last May, a septuagenarian member of the community fishing association brought the children to Lake Ducrest, to train in a place reserved for them. He encounters two young adults fishing, and points out that they have no business being there. Several exchanges of bird names have taken place: the dispute is no longer ongoing.
A few months later, in July, the fisherman’s path crossed again with the two youngsters on the way to Lac Ducrest: he gave them a simple hello before parking. “Then one of the two men would open the door and punch him in the face, while his colleague was trying to get him out of the car”, Catherine Sargenti summarized. The man who struck the first blow lost his anger: “The septuagenarian thinks he received about ten blows. He called for help and asked to stop, but no one helped. The victim was prescribed total incapacity for work for four days.
The plaintiff quickly identified his main culprit, in his thirties, although he denied the facts for a long time. During the hearing, the latter finally confessed: “I brought these blows, and I apologize. This person disrespected me and pissed me off. “Two months after the first fight, -think of your resentment to the point of causing this man an open wound and massive bruises: it’s disturbing,” said Catherine Sargenti.
“After this surge of violence, this 72-year-old fisherman isolated himself for fear of being attacked again”, explained the plaintiff’s lawyer, Me Julien Marco, who is asking for 3,000 euros in compensation . For Rodolphe Jarry, “This is completely gratuitous aggression. The defendant attacked a person who was unable to defend himself. The vice-president of the court complies with the requests of the prosecutor by condemning thirty-one objects to a fine of 750 euros. He also has to pay 1,000 euros in damages to the victim.

The Public Prosecutor’s Office will ensure the proper distribution of cases, knowing that the hearing time in the Pau court is problematic. This Wednesday, December 7, the final day in office of court vice-president Catherine Sargenti, who asserted her retirement rights.She will be replaced by Charlène Bernadet.
